Ghana FDA to enforce strict advertising approvals for all food services establishments by December 1.

The Food and Drugs Authority (FDA) has issued a directive requiring all food service establishments to obtain FDA approval for advertisements across all media platforms by December 1, 2024.

In a statement signed by Madam Delese Mimi Darko, the Chief Executive Officer, and distributed to the Ghana News Agency, the FDA stated that food establishments advertising without valid approval are in breach of the FDA Guidelines for the Advertisement of Regulated Products and Section 100 (2) of the Public Health Act 2012, Act 851. This section specifies that “a person shall not advertise food unless the advertisement has been approved by the Authority.”

Additionally, the statement referenced Section 129 of Act 851, which outlines penalties for violating this regulation. “Individuals who contravene these provisions are subject to summary conviction, a fine of not less than 7,500 penalty units and not more than 15,000 penalty units, or imprisonment for a term of not less than 15 years and not more than 25 years, or both,” it noted.

The FDA emphasized that these measures will be strictly enforced to uphold public health standards and ensure safety. The directive applies to a wide range of establishments, including restaurants, bakeries, canteens, online food vendors, institutional catering services, and fast-food outlets. Advertisements for these establishments on billboards, social media, and other media must comply with FDA Advertisement Guidelines and secure the Authority’s approval.

According to the FDA, approvals for advertisements are valid for one year and must be renewed annually. The statement also reminded live media presenters promoting FDA-regulated products to adhere strictly to approved scripts, maintaining consistency with FDA guidelines.

In addition, the FDA urged the public to remain vigilant, specifically regarding affected batches of Benylin Paediatric Syrup, and to report any concerns to FDA offices nationwide. The Authority expressed appreciation for the cooperation shown in supporting public health and ensuring regulatory compliance.
